He wants to marry a Christian woman and he wants to convince her that it is forbidden to keep a dog in the house

 

Why is dog not permissible in the house ? I know it is mentioned in the hadith, I accept it because I am a muslim but how can I justify it to my future wife who is a christian, I need strong points ? Why ?.

Praise be to Allaah.

Firstly: 

Before answering this
question, you have to understand that your Prophet Muhammad (peace and
blessings of Allaah be upon him) has encouraged you to make a good choice
when choosing a wife, the righteous wife whom the husband can trust with his
children, house and wealth. It was narrated from Abu Hurayrah (may Allaah be
pleased with him) that the Prophet (peace and blessings of Allaah be
upon him) said: “Women may be married for four things: their wealth, their
lineage, their beauty and their religious commitment. Choose the one who is
religiously-committed, may your hands be rubbed with dust (i.e., may you
prosper).” Narrated by al-Bukhaari, 4802; Muslim, 1466. 

This advice from the
Prophet (peace and blessings of Allaah be upon him) does not mean
choosing between a Muslim woman and a kitaabi woman (a Jewish or Christian
woman), rather it means choosing from among Muslim women, because if not
every Muslim woman is recommendable for marriage, then it is more likely
that it is inadvisable to marry a non-Muslim woman, a Jew or Christian. The
issue with regard to marrying them is that it is simply permitted in Islam.
Undoubtedly marriage to a righteous Muslim woman will help the Muslim to
obey his Lord and help in raising righteous children. 

Shaykh Muhammad ibn Saalih
al-‘Uthaymeen (may Allaah have mercy on him) said: 

A religiously-committed
Muslim woman will help him to obey Allaah and will be good to raise his
children, and protect herself in his absence, and protect his wealth and his
house, unlike a woman who is not religiously-committed, who may harm him in
the future. Hence the Prophet (peace and blessings of Allaah be upon
him) said: “Choose the one who is
religiously-committed.” If along with religious commitment there is
also beauty, wealth and good lineage, then that is light upon light.
Otherwise, what he should choose is the one who is religiously-committed.
End quote. 

Al-Sharh al-Mumti’
(12/13). 

Secondly: 

Marriage to a kitaabi woman
– whether Jewish or Christian – is permissible in principle, and there
should be no difference of opinion concerning that, because it is stated in
the Book of Allaah. But the Muslim should pay attention to the conditions of
that permissibility, and think of the consequences of that marriage. One of
the conditions of marriage to kitaabi women is that the woman should be
truly Christian or Jewish, because in the kaafir lands there are many women
who have no religion at all, or women who are Buddhists or follow other
idolatrous religions. The second condition is that she should be chaste, and
not a zaaniyah (one who engages in fornication or adultery); she should not
make friends with non-mahram men. Another condition is that guardianship of
the children should belong to the Muslim, and they should be raised in
accordance with the Book of Allaah and the Sunnah of His Prophet (peace
and blessings of Allaah be upon him). 

Allaah says (interpretation
of the meaning): 

“Made
lawful to you this day are At‑Tayyibaat [all kinds of Halaal (lawful) foods,
which Allaah has made lawful (meat of slaughtered eatable animals, milk
products, fats, vegetables and fruits)]. The food (slaughtered cattle,
eatable animals) of the people of the Scripture (Jews and Christians) is
lawful to you and yours is lawful to them. (Lawful to you in marriage) are
chaste women from the believers and chaste women from those who were given
the Scripture (Jews and Christians) before your time when you have given
their due Mahr (bridal-money given by the husband to his wife at the time of
marriage), desiring chastity (i.e. taking them in legal wedlock) not
committing illegal sexual intercourse, nor taking them as girlfriends”

[al-Maa’idah 5:5]. 

Even though it is
permissible if these conditions are met, it is better not to marry her. 

The scholars of the
Standing Committee for Issuing Fatwas said: 

It is permissible for the
Muslim to marry a kitaabi woman – Jewish or Christian –if she is chaste and
free (i.e., not a slave), because Allaah says (interpretation of the
meaning): “Made lawful to you this
day are At‑Tayyibaat…”  

But not marrying her is
better and safer for the believer, lest she attract him and his children to
her religion. End quote.

Thirdly: 

With regard to keeping dogs
in the house and the prohibition on that, it is narrated in clear saheeh
texts. It is not permissible to keep dogs except for hunting, guarding
livestock, or farming. The Muslim knows that sharee’ah only forbids a thing
because of its evil and harm. 

All the Muslim has to do is
to respond to what his Lord has enjoined him to do or forbidden him. He
should know for certain that He does not prescribe anything unless it is for
a reason. Some shar’i rulings are purely the matter of worship, and we do
not know the wisdom behind them and the reason of some is rationally
understood. There is nothing to prevent us seeking the wisdom behind
rulings, but the Muslim should still heed the commands of Allaah.

We are certain that the
prohibition on keeping dogs is in the Muslim’s interests, and that keeping
them is harmful and bad. Among the negative consequences of keeping them are
the diseases that they cause and that are transmitted via them, whether it
is from a vessel from which the dog has drunk, or in its faeces with which
the house in which it is kept is contaminated. This is what you can tell
this Christian woman if you marry her. 

It was narrated that Abu
Hurayrah (may Allaah be pleased with him) said: The Messenger of Allaah
(peace and blessings of Allaah be upon him) said: “The purification of the
vessel of one of you, if a dog licks it, is to wash it seven times, the
first time with dust.” Narrated by Muslim (279). 

The word “purification”
indicates that the vessel becomes impure (najis) if a dog licks it. This is
what has been proven by modern science, but we never doubted that it is
true. The vessel can only be purified by water and dust, and not any other
cleaning substance. This has also been proven by modern science, which
confirms that this religion is nothing other than revelation that was sent
to the Prophet (peace and blessings of Allaah be upon him).

It has been proven that
there are many diseases that may be caught by the person who keeps a dog, or
touches it, or kisses it. We have mentioned some of them in the answer to
question no. 69840.

Eating with people who are drinking wine at the same table

 

It it permissible for a muslim to eat with non muslims people who drink wine on the same table.

 

[al-Nisaa’
4:140 – interpretation of the meaning]al-Tabari
said: this aayah clearly indicates that it is not allowed to sit with
the people of falsehood of any kind, when they are indulging in their
falsehood. “(but if you stayed with them) certainly in that case
you would be like them” [al-Nisaa’ 4:140 – interpretation of the meaning].
Ibn Katheer said: i.e., you would be like them in sinning.

It is haraam to sell an item without pointing out its faults, even if he is selling it to a kaafir

 

If i want to sell my car to a non muslim person and iknow that there is some thing wrong with it. do i have to tell the person who want to buy it?.

The one who sells an item
in which there is a fault must point out its faults, whether he is selling
it to a Muslim or a kaafir, otherwise he will be deceiving and sinning. 

Al-Bukhaari (2079) and
Muslim (1532) narrated that Hakeem ibn Hizaam (may Allaah be pleased with
him) said: The Messenger of Allaah (peace and blessings of Allaah be
upon him) said: “The two parties to a transaction have the option (of
cancelling it) until they part. If they are honest and disclose any defects,
their transaction will be blessed, but if they lie and conceal defects the
blessing will be erased.” 

Al-Haafiz ibn Hajar (may
Allaah have mercy on him) said: “If they are honest” means, on the part of
the seller with regard to the price and on the part of the buyer by paying
off. “and disclose any defects” means, disclose any faults in the price and
in the goods for which it is paid, so it applies on both sides; the same
applies to any shortcomings. The hadeeth shows that they will attain the
blessing if they meet the conditions, which are honesty and disclosure of
any defects, and the blessing will be erased if the opposite is the case,
namely lying and concealment of defects. Will the blessing be given to one
of them if he fulfils the conditions but the other does not? The apparent
meaning of the hadeeth suggests it will. End quote from Fath al-Baari. 

Ibn Qudaamah (may Allaah
have mercy on him) said in al-Mughni (4/108): If a person knows that
there is a defect in his goods, it is not permissible for him to sell them
unless he discloses it to the purchaser. If he does not disclose it then he
is sinning.  This was stated by Ahmad, because of the report of Hakeem ibn
Hizaam that the Prophet (peace and blessings of Allaah be upon him)
said: “The two parties to a transaction have the option (of cancelling it)
until they part. If they are honest and disclose any defects, their
transaction will be blessed, but if they lie and conceal defects the
blessing will be erased.” Agreed upon. And he (peace and blessings of
Allaah be upon him) said: “The Muslim is the brother of another Muslim, and
it is not permissible for a Muslim to sell his brother goods in which there
is a defect, without pointing that out to him.” End quote. 

He also said (4/113): The
meaning of concealing faults is concealing them from the purchaser
knowingly, or hiding them from him in such a way that the purchaser thinks
there are no defects; both are deception which is haraam  

The hadeeth “The Muslim is
the brother of his fellow Muslim…” was narrated by Ibn Majaah (2246) and
classed as saheeh by al-Albaani in Saheeh Ibn Majaah. The prohibition
on deceit does not apply only to dealing with Muslims, rather it is haraam
to deceive both Muslims and kaafirs, but the word Muslim is used here
because in most cases one Muslim deals with another. 

Al-Subki (may Allaah have
mercy on him) said in Takmilat al-Majmoo’ (11/306): The general
prohibition on deceit referred to by the author (may Allaah have mercy on
him) [al-Raafa’i], his companions and al-Shaafa’i and the obligation of
pointing out any defects includes cases where the purchaser is a Muslim or a
kaafir. The words of the hadeeth quoted and used as evidence by the author
(may Allaah have mercy on him) refers to a Muslim dealing with a Muslim.
This was narrated concerning a Muslim proposing to a woman to whom his
brother has already proposed, or outbidding him. The majority of scholars
(may Allaah have mercy on him) are of the view that there is no difference
in this case between a Muslim and a kaafir. As for limiting the meaning of
these ahaadeeth, they only mention Muslims because it is usually the case
that one Muslim deals with another, or it may be that the aim is show how
abhorrent it is to do such a thing to someone who is Muslim like you. The
fact that it is general in meaning is also proven by other evidence. And
Allaah knows best. End quote. 

He also said: 

The ahaadeeth which forbid
deceit and enjoin honesty are very many, and the ruling is known from
sharee’ah. Concealing faults is deceit. End quote from al-Majmoo’
(11/303). 

So you have to disclose the
faults that you are aware of in your car, whether you are selling it to a
Muslim or a kaafir.

Keeping pictures on cell phones

 

I read your answer about the ruling on keeping pictures for memories, and after that I burned the pictures that I had, but there are some pictures of me that my sisters and paternal aunts have. What should I do? If they refuse to give them to me, what should I do? And what is the ruling on keeping pictures on cell phones?.

Praise be to Allaah.

It is not permissible to keep pictures of animate beings for
memories. This has been discussed in the answer to question no.
10668. 

There is no sin on you if your sisters and aunts keep these
pictures, but you have to explain the shar’i ruling to them and advise them
to get rid of them. You should ask them for the pictures that they have of
you, but if they refuse there is no sin on you. 

Secondly: 

With regard to pictures on cell phones, computers and videos,
these do not come under the same ruling as photographs, because they are not
tangible, unless they are printed. Based on that, there is nothing wrong
with keeping them on the cell phone, so long as they do not include anything
haraam, such as if they are pictures of women.

Buying magazines and catalogs in order to take women’s fashions from them

 

What is the ruling on buying catalogues of the western clothes, in order to buy through them and avoid going to markets? Knowing that these catalogues contain men and women in underwear only (almost naked)! So what is the ruling on this?


Is it permissible for a woman to look at another woman who is only in underwear, For the purpose of buying? I hope you give me a detailed convincing answer.

Praise be to Allaah.

It is not permissible to buy the catalogues mentioned,
because they contain indecent images which it is not permissible for a man
or a woman to look at. 

It is well known that the ‘awrah of a man before other men,
and the ‘awrah of a woman before other women, is the area between the navel
and the knee. These images include uncovering of the ‘awrah as you say, and
this is in addition to the fitnah and evil which may be caused by them for
the men, women or children who look at them. 

The Standing Committee for Issuing Fatwas was asked: What is
the ruling on buying magazines in which there are images of women so as to
take ideas for designs that may be in accordance with our sharee’ah and
ignoring those that go against it? 

They replied: 

It is not permissible for you to buy these magazines in which
there are images of different styles because of the fitnah contained in
these magazines and because by buying them you are helping them to continue
to produce these harmful images. You should be content to wear the clothes
that women in your country wear.  

And Allaah is the Source of strength. May Allaah send
blessings and peace upon our Prophet Muhammad and his family and
companions. 

End quote from Fataawa al-Lajnah al-Daa’imah (13/75). 

It also says (1/468): As for the indecent pictures that are
found in the magazines, it is not permissible to buy them or bring them into
the house, because of the negative consequences that outweigh the benefit
sought – if there is any benefit – otherwise the matter is more forbidden.
The Prophet (peace and blessings of Allaah be upon him) said: “That
which is halaal is clear and that which is haraam is clear, and between them
are doubtful matters which many people do not know. Whoever avoids the
doubtful matters will have protected his religious commitment and his
honour, but whoever falls into the doubtful matters will fall into haraam,
like a shepherd who grazes his flock around a sanctuary and soon will
transgress upon it. Every king has a sanctuary and the sanctuary of Allaah
is His sacred limits.” And he (peace and blessings of Allaah be upon
him) said: “Leave that which makes you doubt for that which does not make
you doubt.” And he (peace and blessings of Allaah be upon him) said to
a man who came and asked him about righteousness: “Righteousness is that
with which your heart and soul feels at ease, and sin is that which wavers
in the heart and you feel hesitant about it, even if people advise you to do
it.”

Shaykh Ibn ‘Uthaymeen (may Allaah have mercy on him) was
asked about the ruling on buying books which contain pictures.

He replied: Books which contain pictures may be divided into
two categories: those who are made for the purpose of the pictures, such as
that Burda magazine, which it is not permissible to buy or keep, because the
purpose behind it is the pictures; and another kind which is not made for
the purpose of the pictures, rather it is aimed at some useful purpose, but
it may contain a picture of the person who wrote the article. There is
nothing wrong with keeping these, because it is too difficult to avoid them,
and because it is also too difficult to go through them and erase all the
pictures. And it is permissible to sell them because if it is permissible to
use them it is permissible to sell them. 

End quote from Liqa’ al-Baab il-Maftooh (21/115). 

And he (may Allaah have mercy on him) said: I warn you
against bringing these magazines and journals that are filled with
attractive images, misleading words and deviant fashions, into your homes
and letting your families get their hands on them, for you will destroy them
and ruin their morals and values. Everything that is shown in these
magazines and journals will have an effect on those who look at them and
read the ideas mentioned in them.  

O believers, keeping these magazines and journals in your
homes will prevent the angels from entering them, because the angels do not
enter any house in which there is an image. What do you think of a house
that the angels do not enter? Keeping such magazines is haraam, buying them
is haraam, selling them is haraam, making money from them is haraam,
accepting them as a gift is haraam, and everything that helps to publish
them among the Muslims is haraam, because it is cooperating in sin and
transgression, and Allaah says (interpretation of the meaning): “Help you
one another in Al‑Birr and At‑Taqwa (virtue, righteousness and piety); but
do not help one another in sin and transgression” [al-Maa’idah 5:2]. 

Fear Allaah, O slaves of Allaah, and beware of keeping these
magazines and journals; burn them for proof is established by what you have
heard. Burn these magazines and destroy them; do not leave them in the hands
of your wives or sons or daughters. Beware of spending money on them or
subscribing to them, for that involves many evils, such as wasting money
that Allaah has given to people to spend on their religious and worldly
interests, and wasting money on something that is of no benefit, or on
something that may be harmful. It is proven that the Prophet (peace and
blessings of Allaah be upon him) forbade wasting money.

Ruling on taking pictures of the washing of the deceased as a lesson or reminder

 

What is the ruling on taking pictures of the washing of the deceased on a video tape, then selling it on the grounds that it is for the sake of reminding people of death?

Praise be to Allaah.
 

 

If what is meant is taking pictures of the deceased whilst he
is being washed, that is not permissible, because the Prophet (peace
and blessings of Allaah be upon him) forbade making images of animate beings
and he cursed the image-makers and said that “they will be the most severely
punished of the people on the Day of Resurrection.” 

But if what the questioner means is in order to explain how
to wash the deceased in the manner prescribed by Allaah on a video cassette
tape which is to be distributed and sold, then there is nothing wrong with
that, just as recordings may be made to teach people how to pray and other
things which people need, but without making still pictures or photographs. 

May Allaah help us all to acquire beneficial knowledge and to
do righteous deeds.

Are photographs permissible by analogy with images in the mirror?

 

If a man sees his face in the mirror, is this regarded as one of the kinds of image-making that are forbidden? May Allaah bless you.

Praise be to Allaah.

If a man sees his face in
the mirror, this is not regarded as one of the kinds of image-making that
are forbidden. The scholars have explained the difference between the two
matters, refuting those who use that as evidence to say that photography is
permissible.  

Shaykh Ibn Baaz (may Allaah
have mercy on him) said – refuting those who regard them as the same - : You
have made a mistake by regarding them as the same and drawing an analogy,
for two reasons: 

1 – A photograph cannot be
likened to the image in a mirror, because a photograph does not disappear
and the temptation caused by it is still there. 

As for the image in a
mirror, it is not permanent and it disappears when the person who is facing
the mirror goes away. This is an obvious difference which no man with any
common sense can dispute. 

2 – The text that came from
the infallible Prophet (peace and blessings of Allaah be upon him)
forbids images in general and states that things that are like photographs
are forbidden, such as images on garments and walls.  

It is narrated from him
(peace and blessings of Allaah be upon him) in several saheeh ahaadeeth
that when he saw that ‘Aa’ishah had a curtain in which there were images, he
got angry and tore it down and said: “The most severely punished of people
on the Day of Resurrection will be the image-makers). 

In another hadeeth he said:
“The makers of these images – and he pointed to the images on the cloth –
will be punished on the Day of Resurrection and it will be said to them:
‘Give life to that which you have created.’” 

And it is proven that he
(peace and blessings of Allaah be upon him) erased the images that were
on the walls of the Ka’bah on the day of the Conquest (of Makkah), which
come under the same ruling as photographs. If we accept that photographs are
like images in mirrors, then we cannot draw an analogy because it is
established in sharee’ah that there is no room for analogy when there is a
text, rather analogy comes into play when there is no text as is well known
to the scholars of usool and all scholars. End quote from Majmoo’ Fataawa
al-Shaykh Ibn Baaz (27/442). 

It says in Fataawa
al-Lajnah al-Daa’imah (1/673): Photography is not like the reflected
image seen by one who stands in front of the mirror, because that is a
fleeting image that disappears when the person moves away from the mirror,
whereas the photograph is permanent and remains after the person moves away
from the camera, and it may be the cause of fitnah with regard to belief
(‘aqeedah) or it may be a cause of temptation (as in the case of pictures of
women). Photographs may be used in cases of necessity on some occasions and
put in passports, identity documents, residency permits and drivers’

Photography is not only the
reflection of an image, rather it is created by means of a machine that
captures the image, therefore it is trying to match the creation of Allaah
using this machine. Moreover the prohibition on image-making is general
because it involves trying to match the creation of Allaah and it poses a
danger to religious beliefs and morals, regardless of the tools used or the
method in which the images are made. End quote.

Is it permissible for him to work in production of animated pictures?

 

One of my cousin wants to take 3D animation as his profession; hes very interested in it ;and alhamdulillah he has a ample knowledge with gr8 languages like HTML; DHTML;VB etc; but he is doubtful whether 3D animation is prohibited in islam; as the Photograpy is often referred to; before he takes up 3D animation as his profession he wants to know the views on this frm references frm the authentic sources or hadees..kindly do reply if u hav any idea related to it.

If the animated pictures are of inanimate things – such as
trees and cars – there is nothing wrong with producing them or watching
them, because they are just drawings. But if they are of animate things –
such as human beings and animals – then this is something concerning which
contemporary scholars differed. The scholars of the Standing Committee are
of the view that it is not allowed to make animated pictures and cartoons
even if they are for shar’i purposes.  

In a fatwa of the Standing Committee (no. 19933, dated
9/11/1418 AH) it says: 

It is not permissible to buy, sell or use cartoon movies,
because they include haraam images. Raising children should be done in ways
that are Islamically acceptable with regard to teaching, disciplining,
telling them to pray and taking good care of them. 

Shaykh ‘Abd al-‘Azeez ibn Baaz, Shaykh ‘Abd al-‘Azeez Aal
al-Shaykh, Shaykh Saalih al-Fawzaan, Shaykh Bakr Abu Zayd. 

Shaykh al-‘Uthaymeen (may Allaah have mercy on him) was of
the view that it is permissible, as we have quoted him in the answer to
question no. 71170. 

Based on the view that it is permissible, the one who
produces them has to pay attention to a number of things, such as: 

1-   
Not showing prominent figures
or leaders of jihad in funny ways, or showing them as saying things that
they did not say. 

2-   
Not including music in films
and animated pictures. 

Shaykh Ibn ‘Uthaymeen (may Allaah have mercy on him) said: 

There are some reservations. They should not attribute to any
of the leaders of these conquests things that they did not say. This is the
problem. I think that if these movies contain only that which is good, then
there is nothing wrong with them, in sha Allaah. But if they are accompanied
by music then this is not permissible, because music is haraam. 

Liqaa’aat al-Baab il-Maftooh

3-   
Not showing men or women with
their ‘awrahs uncovered or doing any haraam actions or actions of kufr such
as wearing a cross or worshipping idols, even if that is for the purpose of
teaching and acting. 

4-   
These films and animated
pictures should convey a good message, or include things that teach good
morals. 

5-   
The drawings and images should
not resemble the creation of Allaah, so that the small child will not think
that there is someone who makes things like the creation of Allaah. 

6-   
There should be no veneration
of any bid’ah (innovation) or innovator, or of any evil deed or evildoer,
and it should not include any mention of any innovated or haraam occasion
such as celebrating the Prophet’s birthday or anyone else’s birthday. 

7-   
There should be no
representation of the Prophets or Sahaabah, even if the stories are true.

Whatever the case: 

The producer should think about what he is going to produce
for the new generation, because they are going to be influenced by what they
hear and see. So he should strive to convey the pure message of Islam and
play a role in giving children an Islamic upbringing. So he should include
in his films and cartoons respect for and teaching of prayer, honouring
one’s parents and reminders of their rights, and other great Islamic
virtues, as well as warning against disobedience to parents, lying, severing
family ties and so on. We hope that the good things in these drawings and
films will outweigh the evils of image-making and drawing. If there was
unanimous agreement among the scholars we would not have said that it is
permissible, even if there are numerous benefits in it, but because there
are texts which make an exception for toys, even if they resemble animate
beings, for children, and there are some of our scholars who say that it is
permissible, we have inclined towards the view that it is allowed.

He has manufactured items in the shape of animals; can he melt them down and make use of them?

 

I am in a business of selling animals along with other things made out of marble. I recently discovered that it is haram and inshaAllah i am going to get out of this business right away, can you tell what i need to do with the inventory of marble animals i have, do i need to destroy it or can i liquidate it or give it away.

It is not permissible to
manufacture figures and sculptures in the form of animate beings, such as
people, birds and animals, because of the stern warning that has been issued
against that, such as the words of the Prophet (peace and blessings of
Allaah be upon him): “The makers of these images will be punished in the Day
of Resurrection and it will be said to them: Give life to that which you
have created.” Narrated by al-Bukhaari (7557) and Muslim (210).  

And he (peace and
blessings of Allaah be upon him) said: “The people who will be most severely
punished on the Day of Resurrection will be the image-makers.” Narrated by
al-Bukhaari (5950) and Muslim (2109). 

Whoever has any sculptures
which have any inherent value, such as if they are made of copper, bronze or
marble, should not destroy them, rather he should melt them down and make
use of them. 

In Sunan al-Tirmidhi
(2806), Abu Dawood (4158) and elsewhere it is narrated that Abu Hurayrah
(may Allaah be pleased with him) said: The Messenger of Allaah (peace
and blessings of Allaah be upon him) said: “Jibreel came to me and said: I
was going to come to you last night, and nothing prevented me from entering
the house where you were except the fact that at the door of the house there
was a statue of a man. In the house there was a curtain on which there were
images, and there was a dog in the house. 

So order that the head of
the statue that is at the door be cut off, so that it will become like a
tree, and order that the curtain be cut up and made into two pillows that
will be thrown on the floor and stepped over, and order that the dog be
taken out.  

The Messenger of Allaah
(peace and blessings of Allaah be upon him) did that. That dog was a
puppy belonging to al-Hasan or al-Husayn, that was beneath a bed, and he
ordered that it be taken out. Classed as saheeh by al-Albaani. 

It says in Sharh
al-Sunnah: This indicates that if the form of an image is changed by
cutting off its head or dismantling its parts so that nothing is left of it
except a few pieces and an incomplete image, there is nothing wrong with it,
and if it is cut into pieces it is permissible to use it. End quote from
al-Mubaarakfoori in al-Tuhfah. 

It says in al-Mawsoo’ah
al-Fiqhiyyah (12/125): That which is made with haraam images, if any use
can be made of it, then the images should be distorted in such a way that it
is no longer haraam, and it does not need to be destroyed altogether. End
quote.

- Reading Quran and reflecting over the Quran Is our Duty

Read quran and it will guided us to the true teaching of The Prophet Muhammad (Peace be upon him) he summarized the religion of Islam with this statement: “The Religion is naseehah (sincerity)!” So then Tameem ibn Aws, may Allah be pleased with him, then said, “We asked, ‘To whom?’” He said: “To Allah, HIS BOOK holy quran, His Messenger, the leaders of the people, and their common folk.” [Muslim] so to study the religion people should go to the source of and source of Islam is the quran so learning quran and reading quran with the meaning the quran tafsir and then explore the words of wisdom. And for the Muslims the sincerity that is due to the Book of Allah includes doing the quran recitation, listening to quran along with learning the tajweed rules and reciting it beautifully, letting our kids learn quran learning holy quran tafseer and the reasons for its revelation, affirming that it is the Truth, the perfect Speech of Allah and not part of the creation, honoring it and defending it, abiding by the orders and prohibitions found in it and teaching quran to spread the word or truth and calling to it. So by learning quran education online and reflecting over the Quran online, one fulfills an obligation and is rewarded for that. Upon fulfilling this obligation, the Quran then becomes a proof for him on the Day of Judgment! And that is our second benefit we will take by embracing this Noble Book...

He does not pray and he lives with his girlfriend; he wants to repent and marry her

 

There is a French Muslim man who does not pray or fast, and he lives with his Christian girlfriend. He wants to repent and fast, but he is using the fact that this woman is living with him as an excuse. Is it permissible for him to marry her now, knowing that tomorrow is the first day of Ramadaan? If that is permissible, then what is the prescribed shar’i procedure for that?.

Praise be to Allaah.

This person and others should note that not praying is kufr
which puts a person beyond the pale of Islam. Islam does not accept for
any of its followers not to pray or fast and to live with a girlfriend. 

What you have to do is to advise him and explain to him what
Islam really is, which is submitting to the rulings of sharee’ah. The Muslim
should be an example to others, especially in that (non-Muslim) country, for
he is not representing himself only, rather he is representing Islam which
he has embraced and committed himself to. So he has to give up the sin that
he is committing and adhere to the rulings of sharee’ah, especially prayer
which is the thing that distinguishes between Islam and kufr.

 Secondly: 

We are very happy to learn that he wants to repent, so what
is stopping him from repenting? Allaah rejoices over the repentance of His
believing slave. When a person turns to Allaah, Allaah turns to him and
forgives his sin. So he should hasten to repent and not delay it or make it
conditional upon certain things happening, lest he dies without having
repented and he meets his Lord with a burden of sin and may even meet Him in
state of kufr. 

Tell him that Allaah turns bad deeds into good deeds for the
one who repents. Allaah says (interpretation of the meaning): 

“Except those who repent and believe (in Islamic
Monotheism), and do righteous deeds; for those, Allaah will change their
sins into good deeds, and Allaah is Oft‑Forgiving, Most Merciful”

[al-Furqaan 25:70] 

So he must hasten to
repent by giving up all that he is doing that incurs the wrath of Allaah,
namely not praying and living with his girlfriend.

Thirdly: 

If he repents to Allaah, he should note that it is not
permissible for him to marry that girlfriend, not because she is Christian,
but because she is a zaaniyah (fornicatress) – according to what he has
said. One of the conditions of marrying a woman of the People of the Book
(i.e., a Jewish or Christian woman) is that she should be chaste, not a
fornicatress or a woman who has a lover or boyfriend. Allaah says
(interpretation of the meaning): 

“Made lawful to you
this day are At‑Tayyibaat [all kinds of Halaal (lawful) foods, which Allaah
has made lawful (meat of slaughtered eatable animals, milk products, fats,
vegetables and fruits)]. The food (slaughtered cattle, eatable animals) of
the people of the Scripture (Jews and Christians) is lawful to you and yours
is lawful to them. (Lawful to you in marriage) are chaste women from the
believers and chaste women from those who were given the Scripture (Jews and
Christians) before your time when you have given their due Mahr
(bridal-money given by the husband to his wife at the time of marriage),
desiring chastity (i.e. taking them in legal wedlock) not committing illegal
sexual intercourse, nor taking them as girlfriends”

[al-Maa’idah 5:5] 

Allaah has stipulated
that in order to marry them, they must be chaste. It is not permissible for
a Muslim to marry a woman of the people of the Book who is not chaste. Even
if a woman is a Muslim but she is not chaste, it is not permissible for a
chaste Muslim man to marry her. Allaah says (interpretation of the
meaning): 

“The adulterer — fornicator marries not but an adulteress
— fornicatress or a Mushrikah; and the adulteress –fornicatress, none
marries her except an adulterer — fornicater or a Mushrik. Such a thing is
forbidden to the believers (of Islamic Monotheism)”

[al-Nur 24:3]

If he wants to marry her, that can only happen after he
repents and comes back to Islam by starting to pray, and after they both
repent from zina (fornication). 

This applies if he wants to marry her. 

The duty of being sincere (naseehah) compels us to tell him
of the best way we know of setting straight both his religious and worldly
affairs, which is that he should repent to Allaah sincerely, and hasten to
leave this woman without any hesitation or delay, and look for another woman
who is a chaste, believing Muslim. If he repents to Allaah, he will need
someone who understands her religion and will stand by him and encourage him
to obey the Most Merciful after this deviation. As for that woman, even if
she repents from fornication she will never be able to help him to obey
Allaah and she will never be trustworthy with regard to his household, his
wealth and his honour, and she will never be fit to raise his sons and
daughters. We mean nothing but good by offering this sincere advice. Let him
use his mind and avoid being emotional, then he will know that this is
right. 

If he looks around him, he will see other Muslims who have
married non-Muslim women, and how bad their situations are, and how they
regret it and wish that they had not married non-Muslim woman.

Is there any expiation for having intercourse with a woman in her back passage?

 

Is there any expiation for having intercourse with one’s wife in her back passage?.

Praise be to Allaah.

Firstly: 

It is haraam to have
intercourse with one’s wife in her back passage, and the Prophet (peace
and blessings of Allaah be upon him) said that the one who does that is
cursed. 

We have quoted the evidence from the Qur’aan and Sunnah to
show that it is haraam, as well as describing some of the evil consequences
of that, in the answer to question no. 1103 and
6792. 

Islam has not stipulated any expiation for this action, so
there is no expiation for it apart from repentance and regret, and turning
back to Allaah. 

Shaykh Ibn Baaz (may Allaah have mercy on him) was asked:
What is the ruling on having intercourse with a woman in her back passage?
Is there any expiation required of the one who does that?  

He replied: 

Having intercourse with a woman in her back passage is a
major sin and is one of the most heinous acts of disobedience, because it
was narrated that the Prophet (peace and blessings of Allaah be upon
him) said: “Cursed is the one who has intercourse with his wife in her back
passage.” Narrated by Abu Dawood, 2162; classed as hasan by al-Albaani in
Saheeh Abi Dawood. 

And he (peace and blessings of Allaah be upon him) said:
“Allaah will not look at a man who had intercourse with a man or a woman in
the back passage.” Narrated by al-Tirmidhi, 1166; classed as hasan by
al-Albaani in Saheeh al-Tirmidhi. 

What the one who has
done that must do is hasten to repent sincerely, which means giving up the
sin and abstaining from it out of respect for Allaah and out of fear of His
punishment, regretting what he has done of that and sincerely resolving
never to go back to it, as well as striving to do righteous deeds. Whoever
repents sincerely, Allaah will accept his repentance and forgive his sins,
as Allaah says (interpretation of the meaning): 

“And verily, I am indeed
forgiving to him who repents, believes (in My Oneness, and associates none
in worship with Me) and does righteous good deeds, and then remains constant
in doing them (till his death)”

[Ta-Ha 20:82] 

“And those who invoke not
any other ilaah (god) along with Allaah, nor kill such person as Allaah has
forbidden, except for just cause, nor commit illegal sexual intercourse
and whoever does this shall receive the punishment.

69. The torment will be
doubled to him on the Day of Resurrection, and he will abide therein in
disgrace;

70. Except those who
repent and believe (in Islamic Monotheism), and do righteous deeds; for
those, Allaah will change their sins into good deeds, and Allaah is
Oft‑Forgiving, Most Merciful”

[al-Furqaan 25:68-70] 

There is no expiation
required of one who has anal intercourse, according to the more correct of
the two scholarly opinions, and his wife does not become haraam to him
because of that, rather she remains his wife. But she does not have to obey
him in this grave evil; rather she is obliged to refuse, and to demand a
annulment of her marriage to him if he does not repent. We ask Allaah to
keep us safe and sound from that. 

From Fataawa Islamiyyah, 3/256 

Al-Bayhaqi (may Allaah have mercy on him) said: 

If he does that (i.e.,
has intercourse with her in the back passage), then he should be punished
(i.e., the judge or ruler should mete out a punishment that will deter him
and others like him), because he has committed a sin for which there is no
stipulated hadd punishment or expiation. 

Kashshaaf al-Qinaa’, 5/190 

So he clearly stated that it is a sin, but no expiation is
required.

Secondly: 

Many people make the
mistake of thinking that because there is no expiation stipulated for a
particular sin that it is an insignificant matter and is a minor sin. This
way of thinking is not correct. Rather if one were to say that Allaah has
not stipulated any expiation for anal intercourse because it is too serious
to be expiated by any expiation, that would not be farfetched. As Imam
Maalik says concerning swearing a false oath (al-yameen al-ghamoos):
it is too serious to be expiated by any expiation.

Important note to learn and online quran recitation

She wants to give up prayer as she feels shy before Allaah because she is committing zina

 

I know that zina is an immoral and evil action, and I feel too shy to stand before Allaah in prayer after doing ghusl for janaabah because of engaging in zina (unlawful sexual relations). I ask Allaah for forgiveness. Believe me, I do not feel happy and content in myself because of what I am doing, but I am trying to soothe my conscience. Should I go back to praying or not, whilst continuing to commit zina?

Praise be to Allaah.
 

 

Undoubtedly zina is one of the major sins, one of the worst
crimes, one of the most evil and immoral of actions. Allaah says
(interpretation of the meaning): 

“And come not near to unlawful sex. Verily, it is a
Faahishah (i.e. anything that transgresses its limits: a great sin, and an
evil way that leads one to hell unless Allaah Forgives him)”

[al-Isra’ 17:32] 

“And those who invoke not
any other ilaah (god) along with Allaah, nor kill such person as Allaah has
forbidden, except for just cause, nor commit illegal sexual intercourse
and whoever does this shall receive the punishment.

The torment will be doubled to him on the Day of
Resurrection, and he will abide therein in disgrace”

[al-Furqaan 25:68-69] 

Hence Allaah decrees a severe punishment in this world for
those who commit zina, namely the hadd punishment. Allaah says, describing
the punishment for the unmarried person who commits zina:

 “The fornicatress and the
fornicator, flog each of them with a hundred stripes. Let not pity withhold
you in their case, in a punishment prescribed by Allaah, if you believe in
Allaah and the Last Day. And let a party of the believers witness their
punishment.”

[al-Noor 24:2 – interpretation of the meaning] 

But for the muhsan (one
who is or has been married) who commits zina, the punishment is execution.
It says in the hadeeth narrated by Imam Muslim in his Saheeh that the
Prophet (peace and blessings of Allaah be upon him) said: “If a
previously-married man (commits zina) with a previously-married woman, (the
punishment is) one hundred lashes and stoning.” (al-Hudood 3199). 

Because of the abhorrence and obscenity of this action, even
the monkeys are offended by it, and they carried out the hadd punishment of
stoning on a monkey which committed zina, as was narrated in Saheeh
al-Bukhaari from ‘Amr ibn Maymoon who said: “During the Jaahiliyyah I
saw a monkey which had committed zina, so the other monkeys got together and
stoned it, and I stoned it with them.” (al-Manaaqib, 5360). 

How can an adult, accountable Muslim whom Allaah has honored
with Islam be content to stoop to the level of animals and beasts which,
whenever their desire is provoked, they satisfy it however they want? The
seriousness of this sin is not limited to punishment in this world only,
rather the punishment in the Hereafter is far greater and far worse.
According to a hadeeth narrated by Imam al-Bukhaari from Samurah ibn Jundub,
the Prophet (peace and blessings of Allaah be upon him) said: “Two
(angels) came to me last night, woke me up and set out with me… until we
came to something like a tannoor (clay oven), in which there was shouting
and voices. We looked inside and saw naked men and women, towards whom
flames came from beneath them. When the flames reached them, they cried out.
I said to them [the two angels], ‘Who are these people?’… They told me, ‘As
for the men and women in the structure like a tannoor oven, they are the
adulterers and adulteresses…’” (6525).  

If a person dies committing this sin, what will be his
situation? What will he say to his Lord when he stands before Him for
judgement?? Is this the way to give thanks for the never-ending, innumerable
blessings of Allaah? Is this the way to give thanks for the blessings of
good health?  Do you think that Allaah does not see you when you are
committing this great sin? Allaah says (interpretation of the meaning):

“Truly, nothing is hidden from Allaah, in the earth or in
the heaven”

[Aal ‘Imraan 3:5] 

Do you not know that these physical faculties with which you
are disobeying your Creator will testify against you on the Day of
Resurrection? Have you not heard the words of the Compeller (al-Jabbaar): 

“Till, when they reach it (Hell-fire), their hearing
(ears) and their eyes and their skins will testify against them as to what
they used to do.

And they will say to their skins, ‘Why do you testify
against us?’ They will say: ‘Allaah has caused us to speak.’
He causes all things to speak, and He created you the first time, and to Him
you are made to return”

[Fussilat 41:20-21 – interpretation of the meaning]? 

So our answer is that you must hasten to repent sincerely
from this great sin, regret deeply what you have done, immediately give it
up and give up everything that may lead to it. The causes of zina include
the following: 

 1 – Unveiling and wanton display by uncovering the face,
hair or any part of the body. It was narrated in the hadeeth that the
Prophet (peace and blessings of Allaah be upon him) said: “There are
two types of the people of Hell whom I have not seen… Women who are clothed
yet naked, who have gone astray and try to lead others astray also. Their
heads look like the humps of camels, leaning to one side. They will never
enter Paradise nor even smell its fragrance, although its fragrance may be
detected from such and such a distance.” (Narrated by Imam Muslim,
al-Libaas wa’l-Zeenah, 3971). 

2 – Being alone with a
man who is not a mahram for you, because the Messenger of Allaah (peace
and blessings of Allaah be upon him) said: “No man should be alone with a
(non-mahram) woman unless her mahram is present.” (Narrated by al-Bukhaari,
3842). 

3 – Beware of mixing with those whom you are not permitted to
mix with, for zina only happens as a result of that. You must pay attention
to your conscience and do not pay attention to the whispers of the Shaytaan
when he tries to make zina look attractive and to make this crime seem
insignificant. The Shaytaan has sworn by Allaah’s Glory that he will mislead
the sons of Adam. Allaah says (interpretation of the meaning): 

“[Iblees (Satan)] said: ‘By Your Might, then I will
surely, mislead them all,

Except Your chosen slaves amongst them (i.e. faithful,
obedient, true believers of Islamic Monotheism)’”

[Saad 38:82] 

The Shaytaan has gained a victory over you in this way, but
he will not stop at making you fall into this sin, rather he is striving to
make sure that you will abide in Hell for eternity – we seek refuge with
Allaah from that – by making the idea of giving up prayer on the basis of
this false reasoning seem attractive to you. 

Because giving up prayer constitutes kufr or disbelief in
Allaah. In Saheeh Muslim it is narrated that Jaabir ibn ‘Abd-Allaah
said: “I heard the Messenger of Allaah (peace and blessings of Allaah
be upon him) say, ‘Between a man and kufr and shirk there stands his giving
up prayer.’” (al-Eemaan, 116). And he (peace and blessings of Allaah be
upon him) said: “The covenant that differentiates us from them is prayer;
whoever gives it up is a kaafir.” (Narrated by al-Tirmidhi, al-Eemaan,
2545; classed as saheeh by al-Albaani in Saheeh Sunan al-Tirmidhi,
2113) 

So you have to pray a
great deal for forgiveness, repent and make du’aa’. You have to pray
regularly and pray a great deal, and strive to be humble and focused in
prayer, because Allaah says (interpretation of the meaning): 

“and perform As-Salaah (Iqaamat-as-Salaah). Verily,
As-Salaah (the prayer) prevents from Al-Fahshaa’ (i.e. great sins of every
kind, unlawful sexual intercourse) and Al-Munkar (i.e. disbelief,
polytheism, and every kind of evil wicked deed)”

[al-‘Ankaboot 29:45] 

“And perform As-Salaah (Iqaamat-as- Salaah), at the two
ends of the day and in some hours of the night [i.e. the five compulsory
Salaah (prayers)]. Verily, the good deeds remove the evil deeds (i.e. small
sins)”

[Hood 11:114] 

You should not think
that repentance is too difficult or feel that Allaah will never accept your
repentance, for the Shaytaan is keen to sow the seeds of despair in your
heart. 

You should note that whoever repents, Allaah will accept his
repentance and change his bad deeds into good deeds. Allaah says
(interpretation of the meaning): 

“Except those who repent and believe (in Islamic
Monotheism), and do righteous deeds; for those, Allaah will change their
sins into good deeds, and Allaah is Oft-Forgiving, Most Merciful.

And whosoever repents and
does righteous good deeds; then verily, he repents towards Allaah with true
repentance”

[al-Furqaan 25:71] 

The gate of repentance is open, and no one can stand between
you and repentance. The Prophet (peace and blessings of Allaah be upon
him) said: “Allaah will accept the repentance of His slave so long as the
death rattle has not yet reached his throat.” (Narrated by al-Tirmidhi,
al-Da’waat, 3460; classed as hasan by al-Albaani in Saheeh Sunan
al-Tirmidhi, 2802). 

Allaah rejoices over this repentance. According to a hadeeth
narrated by Imam Muslim in his Saheeh from Anas ibn Maalik, the
Messenger of Allaah (peace and blessings of Allaah be upon him) said:
“Allaah rejoices over the repentance of His slave when he repents more than
any one of you would rejoice if he were travelling in the wilderness and his
camel which was carrying his food and drink wandered off, and he despaired
of ever finding it, then he comes to a tree and lies down in its shade,
thinking that he will never see his camel again, then whilst he is like that
he sees it standing next to him, so he seizes its reins and says, ‘O Allaah,
You are my slave and I am Your Lord!’ making this mistake because he is so
happy.” (Baab al-Tawbah, 4932). 

Finally, after you have repented you must cut off all the routes that may lead to evil, by means of the way prescribed in sharee’ah which Allaah has permitted, namely marriage.
You should note that it is not permissible for a Muslim man or woman to marry a person who has committed zina unless he or she repents to Allaah. If he repents and gives up this sin, then it is permissible for you to marry him after he repents. Please see questions no.
